He later claims to Emma his engagement was fake for the sake of Cosy's adopted father, yet he knows what Cosy looks like naked, when he walks in to Emma's room one day, while she's dressing and comments he's seen her naked plenty of times!?!?!?!?!!? When Emma finally goes to bed with him at some point, the next morning, Birck calls her Cosy....not a very believable HEA for this one.
